1. Acceptance and scope

These Terms and Conditions govern access to and use of the Surabhi Realtors website, property listings, account features, enquiry tools, and related services. By using the portal, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the portal.

These Terms apply to visitors, registered users, prospective buyers and tenants, property owners and representatives, and authorised administrators. Mandatory rights available under applicable law are not excluded or restricted by these Terms.

2. Eligibility and accounts

You must be legally capable of entering a binding agreement to create an account or use transactional features. If you act for a company, owner, promoter, or another person, you confirm that you have authority to bind or represent that party.

You must provide accurate, current information, keep your account secure, and promptly update information that changes. You are responsible for activity performed through your account unless caused by a failure for which we are legally responsible. Notify us immediately if you suspect unauthorised access.

3. Nature of the service

The portal helps users discover properties, review available listing information, save properties, and contact Surabhi Realtors or relevant listing parties. Portal content is informational and does not itself constitute an offer, booking, allotment, agreement for sale, lease, brokerage agreement, legal opinion, financial advice, or guarantee of a transaction.

Submitting an enquiry does not reserve a property or create a contractual relationship. Any purchase, sale, lease, brokerage, financing, or related arrangement must be recorded separately between the relevant parties and may be subject to verification, negotiation, documentation, payment, and regulatory requirements.

4. Property information and due diligence

Property descriptions, prices, areas, plans, photographs, videos, amenities, availability, possession timelines, approvals, and other details may be supplied by owners, promoters, representatives, agents, or other sources. They may change without notice and may contain inadvertent errors or approximations.

Users must independently verify title, ownership, approvals, encumbrances, measurements, specifications, taxes, charges, financing, physical condition, availability, and all other material facts before making a payment or entering a transaction. Where the Real Estate (Regulation and Development) Act, 2016 or applicable state rules require project registration or disclosures, users should verify the relevant registration and current information directly with the appropriate Real Estate Regulatory Authority.

Labels such as verified, featured, ready to move, or similar descriptions indicate an internal review or information received at a point in time; they are not a legal certification, warranty of title, or substitute for independent professional due diligence.

5. Acceptable use and submitted content

You may use the portal only for lawful property-search, enquiry, account, and authorised administration purposes. You must not submit false or misleading information; impersonate another person; scrape or harvest data; probe or bypass security; introduce malware; interfere with availability; misuse another account; infringe intellectual-property or privacy rights; send spam; or use the portal in violation of law.

Administrators and listing contributors must have authority to publish submitted material and must ensure it is accurate, lawful, non-infringing, and free of unnecessary personal data. We may review, correct, restrict, archive, or remove content that appears unlawful, inaccurate, unsafe, unauthorised, or inconsistent with these Terms.

6. Intellectual property

The portal, its software, design, branding, text, graphics, and compilation are owned by or licensed to Surabhi Realtors and are protected by applicable intellectual-property laws. You receive a limited, revocable, non-exclusive right to use the portal for its intended purpose.

If you are authorised to submit listing content, you grant Surabhi Realtors a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display, and distribute that content solely to operate, market, and improve the listing and related services. You retain any ownership rights you validly hold.

7. Third-party services

The portal may rely on or link to independent services such as authentication, maps, social networks, media delivery, lenders, legal professionals, or property-related providers. Their services are governed by their own terms and policies. A link or integration does not by itself constitute an endorsement or make us responsible for that third party’s acts, content, availability, or advice.

8. Availability and warranties

We aim to keep the portal accurate, secure, and available, but uninterrupted or error-free operation cannot be guaranteed. We may maintain, update, suspend, withdraw, or modify a feature when reasonably necessary for security, legal compliance, maintenance, or business operations.

To the extent permitted by law, the portal and its content are provided on an as-available basis. We do not make warranties beyond those that cannot lawfully be excluded. Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability or consumer right that cannot be excluded under applicable law.

9. Limitation of liability

To the extent permitted by applicable law, Surabhi Realtors is not liable for indirect, incidental, special, punitive, or consequential loss arising from use of the portal, reliance on unverified listing information, third-party conduct, interrupted availability, or unauthorised use outside our reasonable control.

Any liability that cannot lawfully be excluded will be limited only to the extent permitted by law and assessed in light of the specific service and circumstances. These Terms do not limit remedies available under mandatory consumer-protection or real-estate law.

10. Responsibility for misuse

You are responsible for losses and reasonable costs arising from your unlawful use of the portal, infringement of another person’s rights, unauthorised content, or material breach of these Terms, except to the extent the loss was caused by Surabhi Realtors or cannot lawfully be allocated to you.

11. Suspension and termination

We may restrict or terminate access where reasonably necessary to address a Terms violation, security risk, unlawful activity, inaccurate listing, non-payment under a separate agreement, or legal requirement. Where appropriate, we may provide notice and an opportunity to address the issue.

You may stop using the portal at any time. Provisions concerning intellectual property, property verification, liability, disputes, and any accrued rights continue where their nature requires survival.

12. Privacy

Our handling of personal data is described in the Privacy Policy available at /privacy-policy. By using account or enquiry features, you acknowledge that personal data will be handled as described there and in any specific notice presented when information is collected.

13. Changes to these Terms

We may update these Terms to reflect changes in law, services, security, or business operations. The revised Terms will be posted at this address with an updated date. Material changes will receive additional notice where reasonably practicable or legally required. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer forum, Real Estate Regulatory Authority, or other statutory jurisdiction, courts with jurisdiction in Thane, Maharashtra will have jurisdiction over disputes relating to the portal or these Terms.

Before starting formal proceedings, the parties should attempt in good faith to resolve the dispute through written notice and reasonable discussion, without limiting any urgent or statutory remedy.

15. General terms and contact

If a provision of these Terms is held invalid or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. These Terms, the Privacy Policy, and any separate written agreement governing a specific transaction constitute the applicable agreement for their respective subject matter.
